Trill Family Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the Trill Family mobile application, website, and related services (collectively, the "Service"), operated by Trill Family (the "Company", "we", "us", or "our").
By creating an account, purchasing a subscription, or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Eligibility & Account Registration
Trill Family is designed for a general audience and is suitable for users aged 9 years and older. However, the ability to create an account, agree to these Terms, and manage a paid subscription requires legal capacity.
You must be at least 18 years old (or the age of majority in your jurisdiction) to create and manage an account in your own name and to purchase a subscription. If you are under the age of majority, you may only use the Service under the supervision of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use of the Service.
The Service is not directed to children under the age of 13, and any use of the Service by users under 13 should occur only with the knowledge and involvement of a parent or legal guardian, consistent with our Privacy Policy.
To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
2. Subscriptions, Billing & Cancellation
Trill Family offers a free tier and paid subscription plans (such as Basic, Pro, and Premium) with different usage limits and features. Plan details and pricing are described in the app and on the checkout page.
Paid subscriptions are billed in advance on a recurring basis (e.g., monthly) via our payment processor, Stripe. By starting a subscription, you authorize us and our payment processor to charge your selected payment method for the applicable fees, including any recurring charges.
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time via the account or billing section of the app, or by contacting support at support@trillfamily.app. When you cancel, your subscription will remain active until the end of the current billing period and then will not renew.
We may change our prices or subscription structure in the future, but we will provide notice of any material changes in accordance with applicable law.
3. Use of the Service
The Service is designed to help you preserve, manage, and clone voice recordings of yourself and your family members. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
Because the Service allows you to enter your own text and generate audio, you are solely responsible for the content you create, including any language or themes you choose to include. We expect all users to use the Service in a way that is respectful, lawful, and appropriate for a family-focused environment.
You agree that you will not:
- Use the Service for any illegal, harmful, or abusive purposes;
- Upload, record, or clone voices without lawful permission or consent, where required by applicable law;
- Infringe or violate the intellectual property, privacy, or other rights of others;
- Attempt to reverse engineer, decompile, or otherwise access the source code of the Service, except as permitted by law;
- Bypass, interfere with, or attempt to circumvent any security or usage limits within the Service;
- Use the Service to create deceptive, fraudulent, or misleading content (for example, impersonating another person to cause harm or confusion);
- Use the Service to generate content that is unlawful, hateful, or intended to harass, threaten, or exploit others.
We reserve the right to suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or are otherwise engaged in abusive or harmful behavior.
4. Voice Recordings, Reference Audio & User Content
You may upload or record audio, text prompts, images, and other materials (collectively, "User Content") to use the Service. You retain any ownership rights you have in your User Content, subject to the license you grant to us below.
By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and use that content as necessary to operate, maintain, and improve the Service, including generating voice clones, providing customer support, and complying with legal obligations.
You represent and warrant that you have all rights, consents, and permissions necessary to upload and use the User Content with the Service, including rights for any recorded or cloned voices. You are solely responsible for your User Content and for any consequences of sharing or publishing it.
We may remove or disable access to any User Content that we believe violates these Terms, infringes someone's rights, or is otherwise harmful or objectionable.
5. Privacy
Our collection, use, and disclosure of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
By using the Service, you acknowledge that you have read our Privacy Policy and agree to our handling of your information as described there.
6. Intellectual Property
All rights, title, and interest in and to the Service (excluding User Content), including but not limited to software, text, graphics, logos, and trademarks, are owned by or licensed to us and are protected by intellectual property laws.
Except for the limited license expressly granted in these Terms, we reserve all rights in and to the Service and its content. You may not use our name, logo, or trademarks without our prior written consent.
7. Third-Party Services
The Service may integrate with or rely on third-party services, such as payment processors (Stripe), cloud hosting providers, or analytics tools. These third parties are independent entities, and their services are governed by their own terms and privacy policies.
We are not responsible for any third-party services or for any act or omission of such third parties.
8. Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use of or inability to use the Service;
- Any unauthorized access to or use of our servers or your data;
- Any bugs, viruses, or other harmful code that may be transmitted through the Service;
- Any content or conduct of any third party.
In no event shall our aggregate liability arising out of or relating to the Service exceed the amount you have paid to us in the twelve (12) months prior to the event giving rise to the claim, or, if you have not paid us, one hundred U.S. dollars (US$100).
9. Changes to the Service and These Terms
We may update the Service and these Terms from time to time. If we make material changes, we will provide notice in the app, by email, or by updating the "Last updated" date above.
Your continued use of the Service after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
10. Governing Law & Disputes
These Terms and any dispute arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the state or jurisdiction in which the Company is organized, without regard to its conflict of laws principles.
Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the courts located within that jurisdiction, unless otherwise required by applicable law.
